THE PARTIES: Between the client and/or user, who acts directly, if a natural person or through a person duly authorized to act on behalf and representation, in the case of a legal entity, and on the other hand KRONOTIME SAS, a commercial company duly incorporated under Colombian law, who for all purposes of this document will be referred to as "MALVA". These Terms and Conditions will refer to the "Client(s)" and/or "Client(s)", together with the visitors of the Portal, potential buyers and buyers. Any person who does not accept these Terms and Conditions and the MALVA Data Processing Policy, which are mandatory and binding, must refrain from using, accessing, registering or carrying out any commercial act on it or through the malvaonline.com portal, enter into this contract in accordance with the terms and conditions of use that are an integral part of this contract.

KRONOTIME SAS will, in all cases, presume in good faith that it is contracting directly with the client and/or with its legal representative duly authorized to carry out this type of operations and KRONOTIME SAS will not assume any liability for personal impersonation by any client and/or user.

FIRST PARAGRAPH: To make any purchase, it is essential to register, identify yourself and present yourself as a user on the website. These activities are carried out using an email account and a secret password, which is personal, non-transferable and the exclusive responsibility of the customer.

SECOND PARAGRAPH: The customer is responsible for any use made of the provided password, which may not be transferred or disclosed to third parties under any circumstances. Likewise, the customer must adopt all necessary security measures to prevent misuse or disclosure of the password by third parties. It is recommended that the password be changed periodically.

THIRD PARAGRAPH: In case of loss, forgetting, or disclosure of your password to third parties, you should go to the site's authentication section where there is a "Remember Password" link. THE ACTIVITY: KRONOTIME SAS will provide customers with the colors in which the products can be purchased. These will be displayed as realistically as possible; however, please note that the color chosen may vary with each computer/equipment. Therefore, the company is not responsible for this if the customer requests a change due to an error in the color selection.

ACCEPTANCE OF TERMS: By accessing, browsing, and/or using this Site, the user acknowledges having read and understood these Terms of Use and agrees to be bound by them and to comply with all applicable laws and regulations that are part of Colombian Legislation. THE PROVISIONS : In the event that one or more of the provisions contained in these Terms and Conditions are considered null, illegal or ineffective in any respect, the validity, legality, enforceability or effectiveness of the remaining provisions contained herein shall not be affected or annulled thereby.

All brands, signs, logos, names and any other distinctive signs, as well as utility models and/or industrial designs and other elements of industrial or intellectual property inserted, used and/or displayed on this Site are the exclusive property of KRONOTIME SAS. Any unauthorized use will constitute a violation of these Terms and Conditions and the current national and international regulations on Industrial Property.

All computer, graphic, advertising, photographic, multimedia, audiovisual and/or design material, as well as all content, text and databases made available to you on this Site are the exclusive property of KRONOTIME SAS. All Content on the website is protected by Copyright laws and all applicable national and international regulations. Except as expressly provided in these Terms and Conditions, any act of copying, reproduction, modification, creation of derivative works, sale or distribution, display of the Content, in any way or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or any other means, is prohibited without the prior written permission of KRONOTIME SAS. Under no circumstances do these Terms and Conditions confer rights, licenses and/or authorizations to perform the acts described above. Any unauthorized use of the Content will constitute a violation of these Terms and Conditions and current copyright regulations. The user is only granted a personal, non-transferable, and non-exclusive license and right to display www.malvaonline.com on the screen of a computer or PDA device under his or her control, and to copy the Content owned by KRONOTIME SAS, solely and exclusively for personal, non-commercial use, provided that the user does not modify the Content in any way and that he or she retains all copyright and other proprietary notices contained therein. The user is bound by these Terms and Conditions not to modify the Site software in any way.

The contract for the sale of products is concluded only when the customer, in response to the invitation to offer made by KRONOTIME SAS, submits the purchase offer by selecting the product and makes payment according to the payment methods offered on the website.

In no case will KRONOTIME SAS be obliged under any circumstances to accept a purchase offer. SOLE PARAGRAPH: If the purchase intended to be made exceeds a quantity of five (05) products, KRONOTIME SAS reserves the right to send this purchase offer to the company's business channel as it is considered an institutional sale, in order to avoid the improper marketing of products.

KRONOTIME SAS may accept the offer immediately after payment has been made, which may be accepted in whole or in part.

FIRST PARAGRAPH: Acceptance of the offer will be made by email to the address provided by the customer, with the following words: "Thank you very much for your purchase" or something similar. However, in all cases, the offer will be deemed accepted when KRONOTIME SAS ships the products to the customer.

Our client/user must take into account that mere registration, the provision of the personal key to our client or the submission of information or transaction does not mean acceptance of any offer: In the event that KRONOTIME SAS, for any reason, does not accept the offer made in whole or in part, it will proceed to return the money in whole or in part, as appropriate, to an account owned by the offeror in an amount identical to that deposited in our accounts, without any type of interest, compensation or other items.

Changes and returns are accepted from the maximum term to exercise a change or return, which will be five (5) business days counted from the date of delivery of the product, and from the moment of receipt of the product in perfect condition (in the same conditions in which it was delivered, with its labels) in our warehouse or delivery address, the company may not exceed thirty (30) calendar days to carry out the entire process, whether the exchange of the product or the refund of money.

Shipping costs and other expenses associated with returning the product must be borne by the customer and/or user, except when the "Free Returns" campaign offered on the website is active.

This promotion will be valid for a limited period and will be subject to the conditions and dates established directly by KRONOTIME SAS.

All product prices published on the Portal are expressed in US dollars and correspond to the unit price of each product. They do not include additional shipping costs, taxes, or any other additional charges. Additional charges, such as taxes or shipping, incurred as a result of the purchase will be indicated and reported on the Purchase Order, prior to acceptance.

The total purchase price will be made up of the following items, which will be the customer's responsibility: product value, taxes, and shipping costs, if applicable.

PARAGRAPH ONE: Product prices and availability may change at any time and without prior notice due to updates made to the website. The price considered for calculating payments will be the one in effect at the time of confirming the order on the Website's order form.

If at any time an error occurs in the prices indicated for products on the website, it will be corrected immediately. If a customer makes a purchase based on incorrect pricing or availability information for products published on the website, the customer will be notified of the error. In these cases, the customer may receive a refund within 30 calendar days.

SECOND PARAGRAPH: KRONOTIME SAS will inform or publish the transportation and shipping rate that the goods will have, which will be generated depending on the costs, items and policies of the transportation company, which are independent, autonomous and unrelated to KRONOTIME SAS. Within the cost of freight, the place in Colombian territory to which the purchased products must be sent, their size and weight must be taken into account.

Payment may only be made through the following authorized means:

• Debit card
• Payments with your Paypal account

PARAGRAPH: Before we accept any Purchase Offer, the customer must select the payment terms and conditions for the corresponding price, according to the payment methods specifically set forth on this Site. Although KRONOTIME SAS provides the customer with a secure connection system for the execution of all purchase offers, it will in no case be liable for communication failures with banking or credit institutions, nor for any damages caused to users due to an action or omission by said entities.

Refunds will be issued only for the value paid for the product. Shipping costs, additional charges for nationalization taxes, or other charges incurred during the shipping and delivery process will not be reimbursed.

The refund to the consumer may not exceed thirty (30) calendar days, counted from the moment the corresponding right is exercised and the product has been received in our warehouses, where its condition will be verified to begin the process.

Refunds apply in the following cases:

• Payment reversal
• Effectiveness of the guarantee

Exceptions:

In accordance with the corporate purpose of KRONOTIME SAS, the right of withdrawal does not apply in the following cases:

• Contracts for the supply of goods or services whose price is subject to financial market fluctuations that the producer cannot control.
• Goods made to the consumer's specifications or clearly personalized.
• Goods for personal use.

In these cases, KRONOTIME SAS is not obliged to refund the money.

The law provides that in sales made through electronic commerce mechanisms, such as the Internet, in which a credit card, debit card, or any other electronic payment instrument is used to make the payment, the participants in the payment process must reverse the payments requested by the consumer when they are the subject of fraud, or correspond to an unsolicited transaction, or the purchased product is not received, or the delivered product does not correspond to what was requested or is defective.

For the payment reversal to proceed, within FIVE (5) business days following the date on which the consumer became aware of the fraudulent or unsolicited transaction or that the product should have been received or was received defective or did not correspond to what was requested, the consumer must file a complaint with KRONOTIME SAS, and return the product, when appropriate, and notify the issuer of the electronic payment instrument used to make the purchase of the complaint, which, together with the other participants in the payment process, will proceed to reverse the transaction to the buyer.

KRONOTIME SAS must refund the consumer all sums paid without any deductions or withholdings. In any case, the refund to the consumer may not exceed thirty (30) calendar days from the moment the right was exercised. Refunds are applicable in cases of withdrawal, reversal of payment, and warranty effectiveness.

The products will be shipped to all countries in the world, via certified mail, within a maximum period of ten (10) business days, counted from the acceptance of the offer, as long as there is no unforeseen event or force majeure, including, for example, acts of man or nature, such as strikes, stoppages, revolutions, rebellion, sedition, riots, attacks, power outages, landslides, earthquakes, avalanches, floods, collapsed bridges, among others.

FIRST PARAGRAPH: The shipping address will be the address indicated by the customer in the offer prepared in the format provided for this purpose, which may be the buyer's residence or another designated by the buyer. It is understood that any person present at the address where the delivery is to be made is duly authorized by the customer to receive their order. Therefore, KRONOTIME SAS is exempt from any liability at the time of delivery, provided that the delivery is made to the address registered at the time of purchase on the website.

SECOND PARAGRAPH: The transport company will be obligated to make a maximum of two (2) delivery attempts for the purchased products. In the event that delivery attempts are unsuccessful, the goods will be returned to the factory and the money deposited will be refunded, except for the shipping cost, without any interest, compensation or additional amount and regardless of the cause or origin of the return.

If delivery of the Product is delayed: i) Because the Customer refuses to accept it without any justification; ii) Because it has not been received within two (2) weeks from the first delivery attempt by the transport service company or; iii) Because of the inability of the transport service provider to find the address that has been incorrectly provided by the Customer, KRONOTIME SAS may (without prejudice to exercising any other right or remedy available) not deliver the Product and consequently proceed to notify the Customer that the purchase order has been cancelled due to non-compliance, in which case the Customer will be reimbursed in full.

The invoice will be sent together with the purchased product to the address mentioned by the customer, but in the event that the product is purchased as a gift and the user does not wish to send an invoice, it will be sent via a data message to the email address previously registered by our customer.

The transfer of ownership takes place as soon as KRONOTIME SAS places the good or product in the hands of the transport company, to be sent to the client or the person designated by the client.

FIRST PARAGRAPH: Notwithstanding the foregoing, the client or recipient of the good or product must refrain from receiving it immediately if the packaging or wrapping of the product shows damage, breaks, openings or other similar damage, leaving the appropriate note or record of this fact.

Our customer agrees that the products will be packaged and presented in a plastic bag of the same specifications and quality as KRONOTIME SAS stores use to deliver the products to customers, or in gift wrap, as appropriate and where available.

The client must register the event by e-mail: help@malvaonline.com, informing the full name and ID number of the buyer, order number, invoice number, so that within a period of no more than thirty (30) calendar days, by means of an email or other system that in KRONOTIME SAS's judgment is convenient, the shipment of the product is authorized through the transportation service indicated by KRONOTIME SAS and, if the request is appropriate, send the product to us.

SECOND PARAGRAPH: Without prejudice to the foregoing, all sales made shall be considered as a firm sale, therefore, the return of the product or money that is not supported by law or by an order from a competent authority will not be accepted, said return of money in any case will be made without any type of interest, premiums or additional amounts, and all shipping costs that may have arisen will also be discounted if there is no legal prohibition.

Third Paragraph: Items must retain all original tags and be in perfect condition. They must not be worn, damaged, or washed. Sale items are not eligible for exchange. They must not have any modifications or repairs, including those made by our tailor. The original boxes and packaging must be returned, if applicable. Some of our items, due to their special characteristics, are not subject to exchange: swimsuits, swimwear, underwear, beauty products, jewelry, and accessories. KRONOTIME SAS reserves the right to publish or refrain from publishing any comments made by users of our website regarding our products. Likewise, a comment may be removed from the aforementioned website at any time.

SOLE PARAGRAPH: All comments published must be made in a cordial, respectful language and related to the subject matter being commented on.

SIZES: When selecting a product, the Customer must choose and select the size on the Portal. It is important to note that, in the case of footwear, sizes may vary depending on whether the product is shoes, sandals, boots, or sneakers, as well as the type of socks worn with the product. It is the Customer's responsibility to carefully review the information provided on the Portal and, if in doubt, may request any information they deem necessary through KRONOTIME SAS's Customer Service department. Product exchanges for a different size will be accepted if the item has not been worn, washed, or damaged.

MALVA may modify any information contained on this Portal at any time and without prior notice, up to the moment of validation of a transaction, after which time MALVA will be obligated to maintain the conditions initially offered and in effect at that time.

Without prejudice to the provisions of the mandatory rules of applicable Colombian legislation, KRONOTIME SAS assumes no responsibility, including any liability for any damages or losses, including but not limited to loss of information or profits, the existence of viruses, results of the use or inability to use the materials on this Site, lost business opportunities, or any other damages, even if the user has notified us of the possibility of such damages, or for any third-party claims, except as expressly provided herein. Under the terms set forth herein, KRONOTIME SAS assumes no responsibility for the information provided on the page, including, but not limited to, that relating to products and/or services, notes of interest, opinions, practical advice, and resolution of concerns. The client solemnly declares and maintains:

1. The resources used to make the purchase come from operations, trades, professions, activities or legitimate businesses.
2. The money used to make the purchase was NOT obtained through any type of conduct that is recognized in Colombian law as a criminal offense.
3. I have never allowed third parties to use my accounts or my credit or debit cards to deposit or manage funds whose origin I do not know or whose origin is the result of conduct contrary to the law, especially criminal law.
4. I release KRONOTIME SAS from all liability for any erroneous, false, or inaccurate information provided in this document or for any violation thereof, and I will be solely responsible for it.
